FOIA Requests: Why a FOIA request may help you keep or obtain your Security Clearance
The FOIA, or Freedom of Information Act is defined as a federal freedom of information law that facilitates the full or partial disclosure of information and documents under the control of the United States government that have not yet been released. The FOIA defines which agency records are eligible for disclosure and dictates mandatory procedures for disclosure.
The FOIA becomes pertinent in security clearance cases particularly when a person has had their security clearance application denied or their current security clearance revoked. In either case, the United States government has become privy to information that has caused them to deem a person ineligible for security clearance, and under the Freedom of Information Act, the person whose security clearance was denied or revoked has a right to review the investigative file.
When making a request for the disclosure of records under the Freedom of Information Act, it is especially important to consult with an attorney who is familiar with the FOIA and how it applies to security clearance cases. Appealing Doha Decision
If you receive an unfavorable security clearance decision you have a right to submit a written Appeal to the DOHA Appeal Board. A notice of appeal must be submitted to the Appeal Board in writing and must be received by the Appeal Board within 15 calendar days of the date of the Administrative Judge’s decision. Failure to meet the 15-day deadline can result in the loss of appeal rights and the Administrative Judge’s decision becoming the final decision in your matter. ,
